TERMS OF PURCHASE FOR SPECIFIC PRODUCTS

  1. BILLING:

"MONEY BACK GUARANTEE" REFUND POLICY:

We offer a 30-day Money Back Guarantee on all our Meal Plans and Meal Plan Bundles. While refunding you does require us to pay a fee to our payment processor, we want you to be happy with your purchase. We are a small business and your satisfaction is important to us! As long as you email us within 30 days of your purchase, we will refund the entire purchase price.

RENEWAL POLICY ON SUBSCRIPTIONS

NOT ALL PRODUCTS ARE OFFERED AS A SUBSCRIPTION. Single Meal Plans, Meal Plan Bundles, our Cookbooks, and our Jumpstart Program are generally ONE TIME purchases, unless you select "Subscribe & Save". 

Our Meal Plans are renewable if you select "Subscribe & Save" and are billed monthly or annually from the original date of purchase (based on which plan you select). Your credit card or Paypal account will be charged on that date.

STOPPING YOUR SUBSCRIPTION:

If you wish to stop your membership, you can do so by emailing us before your membership is renewed. After a renewal has been processed, we will stop your billing. All the products you have purchased are yours to keep. Please make sure to download them, as you may not have access to our member site after your subscription cancellation. 

ONE-TIME PURCHASE MEAL-PLANS, COOKBOOKS, RECIPE BOOKS, AND OTHER STAND ALONE DIGITAL PURCHASES REFUND POLICY:

We value you as a customer and we want you to be happy with your purchase. Therefore, we offer a 30-day Money Back Guarantee on all Meal Plans. If you have questions or difficulty accessing your digital downloads, please email us immediately after your purchase so we can assist you. We are here to help!

RENEWAL POLICY ON ONE-TIME PURCHASES

Our one-time purchase products do not renew. You are only billed once, at the time of purchase. You maintain lifetime access to the products you have purchased, and you can save them or print them as you like. 

NUTRITION PROGRAMS, SUCH AS THE 4-WEEK JUMPSTART PROGRAM AND THE THRIVE WEIGHT LOSS PROGRAM: REFUND POLICY: We do not offer refunds on programs. It is the responsibility of the customer to access and use these programs, and if you put in the time and work, you will likely experience excellent results. If you have difficulty accessing your new resources or you have questions, please email us and we would be happy to assist.

COACHING PROGRAMS (NUTRITION GUIDE, NUTRITION JUMPSTART, NUTRITION JOURNEY, OR MEAL PLAN + COACH): We do not offer refunds on coaching that has already occurred. If you are dissatisfied about your coaching for any reason, please contact us as hello at themedimove dot com and we will work with you to come up with a solution. We generally do not offer refunds on unused coaching sessions, unless there are unusual circumstances.

It is the responsibility of the customer to use the services that he/she bought. We will make every effort to get in contact with every coaching customer to schedule sessions, but we are not able to contact a customer with an incorrect email address or phone number.

Packages expire one year from the date of purchase, with the exception of the NUTRITION JOURNEY which includes 12 coaching sessions. This package expires two years from the date of purchase. If your package has expired, please contact us and we can help make things right. Ultimately, we want to see you successful in your health and wellness journey, and we are happy to work with you on making that happen.

The Mediterranean Movement. LLC reserves the right to decline the coaching package purchase (and offer a full refund) of any client that we do not feel is a good match or whose needs falls outside of our scope of work. If you have difficulty accessing your coach, scheduling sessions, or you have any questions at all, please contact us and we would be happy to assist.

  1. DELIVERY OF MATERIALS :

MONTHLY 'SUBSCRIBE AND SAVE' MEAL PLANS:

Your meal plan will be emailed to you every month, at the email address specified during the check-out process. (If you need to change your email address, please let us know). 

ONE-TIME PRODUCTS:

Non-renewable meal plans and digital products are delivered in full via email after purchase. It is the member's responsibility to download all materials and save them for future access. If you experience technical difficulties during the download process, we'd be happy to assist you.

COACHING PROGRAMS (NUTRITION GUIDE, NUTRITION JUMPSTART, NUTRITION JOURNEY, OR MEAL PLAN + COACH):

Our nutrition coaching is a one-to-one service provided directly to customer via an online software platform such as Zoom, Practice Better, or similar or via a phone call. The coaching is schedule between the customer and the nutrition expert once the customer executes a successful payment. The customer will work directly with the Nutritionist to schedule the sessions, usually over email, phone, or through filling out forms/ scheduling surveys. 

Some coaching packages may also come with Meal Plans, Cookbooks, or other digital resources. These resources will usually be sent via email. It is the responsibility of the customer to download and/or print these resources. Please contact us if you run into any issues with scheduling sessions or downloading resources.

All digital products and program materials sold by The Mediterranean Movement are copyright protected and therefore, cannot be distributed or copied without permission. Original content and pictures, including logos, graphics, test, layout, formatting, appearances, images, digital downloads and data compilations are owned and copyrighted by the Mediterranean Movement. All rights are reserved. You agree that you cannot take credit for any content contained in this blog or on the website as your own, or report any of our recipes or content as your own or post on onto any other website without direct links, shares, and credit to The Mediterranean Movement (www.mediterraneandietmealplans.com or www.themedimove.com). Appropriate sharing across social media with links back to our website and attribution for our content is encouraged. Any use of this website in violation of the conditions above may result in legal action and the termination of the user’s right to access this information. By purchasing a digital product, you agree to the terms of purchase. Each product purchased and membership subscription is for one household. The Mediterranean Movement reserves the right to cancel your subscription for sharing, copying, or distributing a meal plan to another household or person as well as re-publishing it or any of the content (such as recipes) online without permission. Sharing login credentials to a Google Drive or Thinkific account to order to give another person access to your Program is also a violation of this term and will lock your account. If you violate our terms, you will not be entitled to a refund.

Never eat something that you are allergic to, even if it is used in one of our recipes. Most of our recipes offer substitutions. You are responsible for purchasing ingredients that will not cause an allergic reaction to you or people you are eating with.

Limitation of Liability:

Under no circumstances shall The Mediterranean Movement be liable for any direct, indirect, punitive, incidental, special, or consequential damages that result from the use of, or inability to use, this site. This limitation applies whether the alleged liability is based on contract, tort, negligence, strict liability, or any other basis, even if we have been advised of the possibility of such damage. Because some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, our liability in such jurisdictions shall be limited to the extent permitted by law.

Indemnification:

You agree to defend, indemnify, and hold The Mediterranean Movement and its employees, officers, and directors harmless from all liabilities, claims, and expenses including attorneys’ fees, that arise from your misuse of this site.

  1. BRANDED INGREDIENTS:
The Mediterranean Movement is a company independent of the respective brands pictured, grocery stores, and food distributors. The meal plans include fresh and shelf-stable ingredients available in most grocery stores and online. We do not require the purchase of a specific brand to make any of our recipes. Our members are free to purchase their favorite brands and some recipes might require substitutions based on product availability.
  1. MEMBER RESPONSIBILITY:

Members are responsible for downloading, accessing, and saving all digital materials. Due to the digital nature of delivery (email) we are unable to track receipt after the purchase. We rely on our members to notify us by email, in a timely manner, when they do not receive a product.

Comments

When visitors leave comments on the site we collect the data shown in the comments form, and also the visitor’s IP address and browser user agent string to help spam detection. An anonymized string created from your email address (also called a hash) may be provided to the Gravatar service to see if you are using it.

The Gravatar service privacy policy is available here: https://automattic.com/privacy/. After approval of your comment, your profile picture is visible to the public in the context of your comment.

Media

If you upload images to the website, you should avoid uploading images with embedded location data (EXIF GPS) included. Visitors to the website can download and extract any location data from images on the website.

Who we share your data with How long we retain your data

If you leave a comment, the comment and its metadata are retained indefinitely. This is so we can recognize and approve any follow-up comments automatically instead of holding them in a moderation queue. For users that register on our website (if any), we also store the personal information they provide in their user profile. All users can see, edit, or delete their personal information at any time (except they cannot change their username). Website administrators can also see and edit that information.
